Is CBD legal in the United States?
Under the 2018 Farm Bill, hemp and hemp-derived compounds including CBD became legal CBD at the federal level, provided the source plant contained no more than 0.3% delta-9 THC on a dry-weight basis. That single threshold created the entire modern CBD market: tinctures, gummies, topicals, and pet products all trace their legality back to it.
So for now, non-intoxicating, hemp-derived CBD remains federally legal. The important nuance is that “cbd legal” has never meant “unregulated.” The FDA still prohibits marketing CBD as a dietary supplement or adding it to food sold across state lines, and states set their own rules on top of federal law.
The 2026 hemp law change every CBD brand must plan for
In November 2025, Congress passed a spending measure that quietly narrowed the federal definition of hemp. Two changes stand out, and both revolve around your packaging:
- Total-THC standard. The legal test shifts from delta-9 THC only to total THC which now includes THCA, delta-8, and similar cannabinoids. Intermediate materials (oils, powders) are capped at 0.3% total THC by dry weight.
- A per-container limit. Finished consumable products are capped at 0.4 mg of total THC per container where “container” means the innermost packaging in direct contact with the product.

The fate of full-spectrum, non-intoxicating CBD is still being contested, and there is active pressure to preserve access to true CBD products but nothing is guaranteed. The takeaway for brands: the compliance line is now drawn per container, which makes accurate fill, dosing, and labeling a packaging problem as much as a formulation one.
Is it legal to ship CBD products? Carrier rules, explained
Yes, shipping compliant hemp CBD is legal today, but each carrier treats it differently. This is where most brands get tripped up.
USPS (allowed, with recordkeeping). USPS permits domestic shipments of compliant hemp CBD under Publication 52. You must retain compliance records lab results showing ≤0.3% delta-9 THC plus any required grower/processor licenses for at least two years, and produce them within 30 days if USPS requests them in writing. International, APO, FPO, and DPO destinations are prohibited.
UPS (allowed, with enrollment). UPS requires active enrollment in its Hemp-Derived Products Shipping Program before you ship. That means a valid state hemp license, a signed agreement, a Certificate of Analysis (COA) showing the delta-9 percentage, lot number, and batch date, and Adult Signature Required on every ingestible shipment. Shipping without enrolling risks account termination and seizure.
FedEx (not viable). FedEx’s prohibited-items policy bans THC-containing products, and in practice this extends to hemp-derived ingestibles even with a compliant COA. It is not a realistic option for consumer CBD shipments.
Across state lines. Federal legality does not override state law. Some states restrict or ban certain hemp products outright, so “legal to ship” also depends on where the package is going. Always screen destination states before you fulfill.
Why packaging is now central to legal CBD
Here is the part most compliance guides miss: the 2026 rule measures THC per container, and carriers demand documentation attached to the package. Compliant packaging is no longer cosmetic; it is your legal paper trail. To ship and sell with confidence, your packaging should support:
